Indicted for a Misdemeanor

Elizabeth Cummings< no role > wife of John Cummings< no role > of the Parish of Saint Giles in the
Fields in the County of Middlesex Bricklayer and Daniel Maloney< no role > of
Buckeridge Street in the said Parish and County Labourer Severally Maketh Oath
and First the said Elizabeth Cummings< no role > for herself saith that Mary Akerman< no role > of
Dyot Street in the Parish aforesaid is a material
witness for this Deponent on the Trial of the Indictment preferred against
her in July Session last for Keeping a Bawdy House and a disorderly house in
the Parish aforesaid and that without the benefit of the Testimony of the said
Mary Akerman as a Witness for this Deponent on the said Trial she cannot
with Safety take her Trial on the said Indictment And this Deponent Saith
that she did on Fridaylast take out a Writ of Subpena forth
said Mary Akerman to appear as a Witness for this Deponent on the said
Trial on Monday the tenth day of September instant and this Deponent
delivered such Writ of Subpena and a Copy thereof to the other Deponent
Daniel Maloney< no role > in orders that he might serve the same on the said
Mary Akeman And this Deponent said Daniel Maloney< no role > for himself
Saith that he this Deponent did on the Seventh day of September instant
and also on the Eighth day of September instant by the desire of the
said Elizabeth Cummings< no role > go to the house of the said Mary Akerman
situate in Dyot Street in the
said Parish of Saint Giles in the Fields in order to serve her with a Copy of the
said Writ of Subpena And this Deponent on both the said days made
Enquiry for the said Mary Akerman at her said House of her Woman
Servant in order to Serve the said Mary Akerman with the said Copy
And this Deponent was on such Enquiry informed by the said Woman
Servant that the said Mary Akerman was gone to Chirtsey in Surrey
but that the said Servant could not tell to whose House the said Mary
Akerman was gone or what time she meant to Return And this [..]
Deponent saith that he Verily beleives such Information of the said
Woman Servant to be true And the said Elizabeth Cumming Further
saith that she did not Cause the said Mary Akerman to go from
her house to avoid being served with the said Writ of Subpena And
this Deponent Saith that she will endeavour to proane the said
Mary Akerman to attend as a Witness for this Deponent at the next
General Quarter Session of the peace for this County And lastly this Deponent
saith that an Account of the absence of the said Mary Akerman the [..]
