Case.

The House of Correction for the County of Middlesex having been Presented by
the Grand Jury to be in a ruinous & decayed state & unfit for the Purposes of a House of
Correction the Justices of the peace in Session Assembled have determined to remove the same
to a more airy & convenient situation

By the Statute of the 17th. year
2d Cap 5. Sat}

By this Clause there does not seem any
provision for removing Houses of C.
but only for enlarging or building
others in addition to the Old ones}

It is Enacted that upon the presentment of the Grand Jury That the
House of Correction already provided for any County Etc is not sufficient that it will be
necessary to provide one or more House or Houses of Correctn. or that such House of Correction
is not sufficient or convenient or wants to be enlarged the Justices of the County Etc in their
General or Quarter Session of the peace assembled shall have full power & Authority to
could erect or enlarge one or more fit or convenient House or Houses of Correction or to
buy or here one or more fit or convenient House or Housesfor that
purpose with a convenient Backside or outlet thereto adjoining or to purchase Land
& Erect such House or Houses of Correction upon part thereof to lay out the rest
of such Land sir such Backside or Backsides Outlet or Outlets according to the true
intent & effect of such presentment And the said Justices being so assembled in
Sessions may & shall conclude & agree upon raising such sums of money as upon
Examination of able and sufficient workmen or any other persons shall appear
to be necessary for building erecting or enlarging such House of Correction
or for purchasing or hiring a House Houses or Land) if thought necessary
for that purpose.

By this Made the whole of the Prchase
money wod. at once or beleived on the county}

The Act of the 22d. Geo: 3d. C. 64 recits
this Act in the Preamble }

And it is by the said Act further Enacted that the Justices in Session may
& shall cause such Sums of Money as shall benecessary for all or any of
the purposes aforesaid to be raised in the same manner as rates are directed to
be caised by an Act made in the 12th. year of the Reign of his present Majesty
intilled An Act for the more easy assessing collecting & buying of County Rates

This Act is Made to explain
& amend Act of the 22d. of
Geo: 30d. C.64}

There does not appear to be any
manner of raising the Expence
therein before mentioned}

By the Act of 24th. George 3d. Cap:55. Sect 2 It is recited "Whereas
the Expences of building rebuilding enlarging or removing and fitting up Houses see
of correction may in some Cases become very burthensome on the Occupiers of in
Land and other the Contributors to the County Rates in case the said Expences
Should be raised in the manner herein before mentioned.
