the Amount of any Estimate approved by the Justices for the Building Rebuilding.
Enlarging or removing and fitting up any house or houses of correction under the powers
of this Act shall exceed one half of the Amount of the Ordinary Annual Assessments
for the County Rate That then and in such Case it shall & may be lawful for the
Justices of the peace within the respire Limites of their Commissions from time to time
to take up and borrow on mortge of the rates herein ments.. by instruments in the
Form Contd.. in the Schedule hereunto annexed or that or the like effect any Sums not
less than £30 nor exceeding £100 each at legal or lower interest all& every such Sum
and Sums of money so borrowed upon the Credit of the Rates to be raised upon
such County

And It is further Enacted That the Justices shall & they are hereby authorized
and required not only to charge the Rates to be raised upon such County with the
Interest of the money so raised on such Securities but also with the paymt.. of a fur
Sum equal at least to the Sum so charged for the Int of such Securities which sd
Sums shall be assessed on such Coy in such manner as Coy Rates are directed to be
assessed by the Laws now in being & paid & applied under the directn of the sd.. Justices
in discharge of the Int & of So many of the prince..Sums on the sd.. Secs.. as such
money will extend to discharge in each year until he whole of the money for wch such
Securities shall be made & the Interest thereof shall be fully paid & discharged

The Justices have agreed for the purchase of Land in cold Bath Fields upon
which they mean to erect their new house of Correction.

It is therefore become necessary to raise a Sum of money (more than half the usual
County Rate) for the purpose of paying for the same but a doubt has Securred wher.. as
there is no express direction or authority for the raising of money for the paymt.. of the
purchase of Land for the purpose of building a house of Correctn. in the Statute of the 24th of
George 3d. above mentd.. the same can be raised under that Act of Parliament by mortge
on the County Rates or wher.. so far as relates to the purchase of the grad.. the same must
not be paid out of the Coy Rate in the manner directed by 17 Geo:2.

The Statute 24 Geo:3 provides for the expence of removing houses of Correctn.. the sate therefore
on which the Building is to be placed seems to be a very necessary part of the removal & estimate
& to include the power of raising Mo: also for the pchase of the Grod.. to which it is to be
removed & the same seems to be very strongly implied by the or.. parts of the said Act

I do not find any purchase of
Lands before mentd.. in this Act

In the 5th.. Sectn- of the sd.. Act it is provided that in case of any such pchase of Lands Tenemts
& Heredits which shall exceed what is necessary to be levied on employedimpliedthe sd.. Justices may sell &
