Indicted for Assaulting
Frances< no role > Wife of Thomas Dempsey< no role >

Robert James< no role > of the parish of Saint Luke in the County of Middlesex
Weaver the Defendant in this Cause maketh Oath and saith that at the
Session of the peace held for the said County of Middlesex in the month of
May last this Deponent was Indicted for assaulting in the said Frances< no role > the
Wife of Thomas Dempsey< no role > And that he did during the same Session appear
and plead Not Guilty to the said Indictment and gave Bail to try his
Traverse thereon at this present Session but this Deponent did not employ
any Attorney on putting in such Bail And this Deponent saith that
he apprehended and believed that if at any time before this present
Session he applied to an Attorney to be Concerned for him in the Defence of the
said Indictment, the Trial could have been brought on And this Deponent
further saith that he did on Friday last Apply to Mr Chetham an Attorney
at Law to be concerned for this Deponent in bringing on the said Trial at this present Session when
Mr Chetham informed this Deponent that it was then too late to give regular
Notice of Trial And this Deponent further saith that he did not Omit to do
what was necessary to bring on the said Trial with any Intent to postpone
the same but intirely through Ignorance and from his being unacquainted
with the Cause of Business at the Sessions.

the County of Middlesex At the General
Quarter Session of the peace holden for the
said County on Monday the 1st day of July
