And Whereas at the instance and desire of the said parties
jointly and respectively by and with the consent of their and each of their
Councell-and Sollicitors The Court Ordered of that all matters in
Difference between the parties touching and concerning the premisses
be Submitted to the Determination and Arbitrament of Titus Taylor< no role >
of Sunbury in the County of Middlesex Carpenter and Thomas Long< no role >
of the same place Baker who were to publish their award in Writing
on or before the Fourteenth day of February then next ensuing being the
first day of the then next General Session of the peace of our Lord the
King to be holden for the County aforesaid ready to be delivered to the
said parties or to such of them as should demand the same, And it
was thereby further Ordered by such Desire and Consent as aforesaid
Provided the said two Arbitrators should not Agree in their Award that
the said Titus Taylor and Thomas Long< no role > Arbitrators as aforesaid should
indifferently make choice of a person as umpire in and concerning
the premisses, so as the said umpire do make and set down his
award and umpirace in writing ready to be delivered to the said Parties
in difference Etc to such of them as should Demand the same on or
before the Eighteenth day of February then next ensuing And it was
thereby also further Ordered that the Recognizances of the
Several Defendants their Main pernors and Pledges be and the
same were thereby respited And Whereas in Persuance of the
aforesaid Order the said Titus Taylor< no role > and Thomas Long< no role > the Arbitrators
aforesaid meet in Order to settle all matters indifference between the said
parties touching Concerning the Pemisses submitted to them by the said
Order But they the said Arbitrators not being able to Agree in their
Determination thereon they the said Titus Taylor< no role > and Thomas Long< no role > the
Arbitrators as aforesaid did in further Persuance of the said Order
indifferently make choice of John Hart< no role > of Sunbury as aforesaid Taylor
as umpire to settle an Adjust all matters in dispute between the said
parties referred to them by the said Order And who was the said
John Hart< no role > the umpire having heard and examined the Titles and
Allegatiory concerning the said premisses in Dispute so referred to him
as aforesaid did on the Seventeenth day of February last past make
declare and Deliver his Award concerning the premisses and thereby
awarded that the said John Parsons< no role > forthwith do deliver unto
the said William Clements< no role > the Goods and effects laid in the said
