In Pursuance of the Order of Reference made at the last
General Session of the Peace for this County, whereby it stands
Refer'd to us, and other Justices, as a Committee, to consider of
the most speedy and effectual means for recovering of the
Books, papers, and Records of the Sessions out of the hands of
Mr. Waller, the late Clerk of the Peace , the said Mr. Waller
not having complied with the Order of Court, therein mentioned,
for delivering them into Court: We, whose names are
Subscribed, having met at Hicks Hall , on Tuesday last,
and taken into consideration the matters to us Refer'd, and
upon reading the said Order, (the Copy whereof is hereunto
Annexed) finding, that by Mr. Waller's
refusal to deliver the Books and Records, or causing them to
to be delivered, According to the said Order, several
Inconveniences and Obstructions have arisen to the Court,
and the Suitors thereto, and many others are likely to happen
and Particularly that the Clerk of the Peace has, by such Detainer
of the Records by Mr. Waller, been disabled a from preparing
the General Estreat of Fines and Forfeitures for the Court
of Exchequer , We do therefore recomend it to the Consideration
of the Court, that a Comittee of Justices be appointed to use
such means, as they shall be advised by Council, to
Compel the said Mr. Waller to produce the Records and
other Things above mentioned.
