save the Felony aforesaid
of Indictment for the Misdemeanor aforesaid or any other Misdemeanor
And the said Richard Crawley< no role > being so taken and in Custody of the Constable
as aforesaid he the said Richard Crawley< no role > either by the Neglect or permission
of the said Constable escaped from him and fled away is that this Dept.
could not then Surrender him the sd. Richard Crawley< no role > Discharge of
the Recognizance aforesaid which this Deponent would have done in Case
be had not escaped as aforesaid and this Dept. believes no Bill of
Indictment was found against the said Richard Crawley< no role > for Misdemeanor
at that Session's Save for the Felony aforesaid And this Deponent saith
that he does beleive that the said Thos. Oakley did not at the time when
he first caused the said Richard Crawley< no role > to be apprehended as aforesd. in
any manner impeach the said Richard Cravley of any Capital Felony
before the Justice who suffered the sd. Richard Crawley< no role > to be Bailed
& who look the Recognizance afored. or at any other time before the finding
of the Bill agst. him for the Felony aforesaid as this Dept. verily beleives
And this Deponent Saith That if he had known that the said Richard
Crawley
< no role > stood Suspected or impeached of Forgery as aforesaid or any other
Capital Felony he this Dept. would by no means have Bailed or
Attempted to Bail the said Richard Crawley< no role > nor as this Deponent
is advised and beleives would or could any of his Majestys Justices of
the peace of his own Authority with propriety of Law have Suffered the
said Richard Crawley< no role > to have bee Bailed in a Base of a Capital
FelonyAnd this Dept. Saith That he hath applyed to Mr. John Fielding< no role >
one of his Majestys Justices of the peace for this Country & Cauzed
persons by his Authority to go into the Country on Horseback Aroned
in quest of the said Richard Crawley< no role > where he this Dept. hath heard &
beleives the said Richard Crawley< no role > was most likely to be found &
apprehended in order to bring him to Justice & hath unsuccessfully spent
therein Three pounds or there abouts And this Dept. hath also three
several times caused the sd. Richard Crawley< no role > to be Advertized in
the publick paper's twice in the Gazetter, & Dailey advertizer
