Middlesex The king against Barrell Smith Kennedy< no role > for Felony

Robert Garner< no role > if the Parish of Saint Andrew Holbourn in the County of
Middlesex Perk Butcher Maketh Oath that he this Deponent Did an bent the
Seventeenth Day of March last Buy of the said Dependant Cue Pair of Leather
Tuggs which this Deponent hath Since found to be the Property of one Mr. Tulins
Tidd (to when the said Deponent was) Servant and Feloniously Hellon from him
And this Deponent one Bound over in a Recognizance before the Worshipfull
Saunders Welch< no role > Esquire One of his Majestys Justices of the peace for the County of
Middlesex to Give Evidence against the said Dependant for the aforesaid Felony And
this Deponent further Saith that he Did Amend at the Lmt April Session at Hicks
Hall and Gave Evidence before the Grand Iwy there against the said Dependant
for the aforesaid Felony find he also Attended this Honourable Court at the said
last Sessions in Order to have Given Evidence there against the said Deponent, on
Wednesday the Thirteenth Day of April last from Nine on the Forenoon till
after Three of the Clock in the Afternoon of the same Day when this Deponent was
Informed the Judge par Gone up to Dinner Pending which Time this Deponent
(being Totally Iquerant of Matters of this Notice having never Attended at this
Lank before Apprehended No Business was to be Transacted, And this Deponent
therefore Precautiously Ventured to go to a Publick House next to the Sessions house
Gate to Refresh himselfe and pas not Absent in the Whole Time above Halfe an
How, But at this Deponents Return to his Great Horprize he was Informed that the
abovenamed prisoner Barrell Smith Kennedy was Hequitted and Discharged
this Lastly this Deponent Saith that his Absence on this Occasion was in neways
Designed to Facilitate the Sequittal of the said Prisoner Barrell Smith Kennedy
But that the Same was Owing Hereby to the above Medsigned headent For
that this Deponent Did Attend Both an the Grand pay at Hicks Hall and at
and a this Present Honourable Caat at the said Last Sessions on the said Thirteenth
Day of April last to the Snew Real and Time Design to Give his Evidence against
the said Prisoner to there my best of his Knowledge Touching the said Felony.
