Roger Pool< no role > of the Parish of Saint Paul Shadwell in the County
of Middlesex Clerk to Mr Heaton Attorney for the Prosecutors in this
Cause maketh Oath That he this Deponent did last Might about
half an hour after Eight o' Clock receive the Notice of Motion hereto
annexed And this Deponent Saith that he hath not nor hath
the said Mr. Heaton or any person on his behalf as this
Deponent is informed and verily believes received any other
Notice of Motion in Writing and this Deponent saith that
Yesterday Mr Ridgway the Defendants Soldicitor informed this
Deponent verbally only at Hicks's Hall near the hour of two
that he would that Day move the Court for the Defend out to be
admitted to Bail and desired this Deponent would take Notice of
it accordingly But this Deponent then informed him that
such Notice was insufficient and he could pay no regard to it
And this Deponent further saith that he hath not nor hath the
said Mr Heaton nor any person on his behalf as this Deponent
is informed & verily believes been served with any order of this or
any other Court in this Cause not with standing what is suggested in
the said annexed Notice
