touching the Death of Barthw. Malahan< no role > then & there lying
dead .

Jno: Ricks< no role > Mariner says he know the deced abt. a
Week before. the accident happen'd That he belonged to the
Press Gang at St. Catherines That last Saturday was for Night
he & the deced were in Company togr. at the Dutch Seailors
abt. 10 at NightThat the Deced went out of the House wth.
a GirlThe Witness stay's behind abt. an Hour & in
going over little Tower Hill with two more of his Gang to
Wit Philip Ricks< no role > & Edwd. Branch< no role > he met the deced [..]
[..] with his Girlhe Stop'd or talk'd to thembut
Philip Ricks< no role > & Edwd. Branch< no role > did not Stop but went forwds.
That is abt. 2 or 3 Minutes a couple of Portuguses &
a Jew Girl Pass'd themthat the Jew Girl Slightly hit the
deceds Girl & the Deceds Girl thinking she had some
Knowleges of the Jew Girl follow'd her abt. 12. or 14
yards That the Portuguese & both the Girls stop'd & began
to abuse the Girl for going after themThat one of the
Portuguese called Antonio Stip'd & offer'd to fight the
Witness or the deced & after he was Step'd Struck the
Witness [..] over the Temple with his First & ran down the Hill
towards the RailsThat the deced follow'd him & there
were Blows on each sideThat he afterwds. Saw the
Portuguese with a Knife in his hand Give a back hand
stroke to the deced & hit him on the Brea [..] rt Bone. That
the Portuguese directly ran away & the deced return'd to
the Witness & said he was Stab'd by the Portuguese. That
the deced came directly home to his Lodging & was thot.
to be then dyingThat he was carried up Stairs & there
languish'd till last Monday Night when he died. Says he
saw the Stroke with the Knife for it was a lightish Star
Light Night & Thinks the Portuguese ran down the Hill
