says the same Day & place between 10 & 11 in the Eveing This Depont. came into the Pewter
Platter
& there saw Mr. Mathews & Mr. Steirn & other persons sitting round One Table in the
middle of the Room, Soon after Mathews & Steirn disputed & used severall approbrious words
or both sides, when Steirn moveing from his Seat came & Stood near a Vacant Seat next but
one to Mr. Mathews within 6 foot of Mr. Mathews when this Depont. moved a side to give Mr
Steirn way to the Table & while this Deponent was morning he heard the Report of 2 Pistolls
fired almost together but saw not the pistolls nor the hand that fired then being behind Mr. Steirn:
After wch Depont. saw Mr. Steirs seized by some Persons there & then Depont. quitted the Room
haveing seen Mr. Mathews reclined on some one of the Company: He Mr. Mathews, a few minutes
before appeared to be very well; but after the Report of the Pistolls some Persons in the sd
Room said He is dead, He is dead, meaning Mr. Mathews.

Wednesday the 13th of August instant This Deponent heard Conversation between Steirn
& Mathews & after many Reproaches between them, Steirn said to Mathews I will have
my Revenge on You, & here's my hand as It, & took hold of Mathew's hand & shook It,
Deponent further says that on the before named 15th. day of August between 10 & 11. in the
Evening this Dept. was at the sd Pewter Platter
& Mr. Steirn & Mathews were with severall
others in Company sitting round one Table in the same Room when & where angry words
passed between Steirn & Mathews, Steirn was standing within 4 foot of Mathews, Steirn
is very tall, and he longed his Arm past this Deponents Body with a Pistoll in his right hand
very near the Breast of the said Mr. Mathews and Steirn fired the same and Mr. Mathews
felt & dyed immediately And then Steirn fired another Pistoll, But Mr. Mathews had no Pistoll

near each Other That as soon as the smoke was gone Deponent saw Mr. Mathews lying an
the Ground dead & the Time was little more than a Minute, Depont. has seen the Pistolls that were
fired as aforesaid & beleives that Mr. Mathews was killed by one of them
