The King agt: Elizabeth Colley< no role > Widow

William Sparry< no role > of Blewets Buildings Fetter Lane London Gentleman the
Defendts. Sollicitor in this Prosecution Makes Oath and Says That the
Defendt. who is a Gentlewoman possessed of a very Considerable Estate in the
County of Middlesex to the Account of Seven Hundred Pounds or there abouts
was at the Prosecution of one Joseph Moore< no role > a Floot Soldier taken upon a
Warrant granted upon Suspicion of a Murder pretended to be committed
by her on the Body of Rebecca his wife on whom the Coroner had before taken
an Inquest and found that she did a Natural Death And says that the said
Mr. Colley being bound over on that Occassion the said Moore who was bound
to prosecute did late on the last Day of the them next Sessions at the Old
Bailey (there not Having been than any Bill of Indictment preferred agst:
her) move the Court there by his Councel for a respite of his recognizance
upon as Affidavit of one of the Kings Witnesses being out of the way and
obtained his Motion which laid the said Mrs. Colley under a Necessity of attending
Again in December Sessions following which she did with this Deponent and her
witnesses at a very Great Expence when a Bill for the said pretended Murder
was preferred by the said Moore Against the said Mrs. Colley and returned by the
Jury no Bill whereupon her recognizance was discharged And this Deponent
says That he [..] verily baleives the said Prosecutions carryed on by the
said Joseph Moore< no role > was a vexations and Malitions prosecution meditated
commenced and prosecuted as aforesaid against the said Mrs. Colley meereby
with a View to extort Money from her or in failure there of to oblige her to
under goe the Expence and Trouble of Defending the Same And says That in Order
to proceed against the said Joseph Moore< no role > for commenceing and Prosecuting the
Same he this Deponent humbly apprehends it will be necessary That Copys of the
Information and of the recognizance entered into as aforesaid and also Copys
of the said Affidavit upon which the said Joseph Moores< no role > Recognizance was
respited to gether with a Copy of the Bill of Indictment by him preferred as
aforesaid and which are all affiled with Mr. Matthews in the Crown Office as this
Deponent is informed and beleives will be absolutely necessary to be had for the
said Mrs. Colley before she can Commence any Prosecution for the very great
Scandall and injury done unto her as aforesaid And this Deponent for their [..]
That he in Hilary Term last applyed to first to his Majesties Attorney General
and afterwards unto the Court of Kings Bench for an Order to obtain such
Copys but received for Answer to the Former Application that he night have
a Copy of the said Bill of Indictment but that it was not usuall for the
Attorney General in such Cases to grant an Order for Copys of so many
things as are above mentioned or to that Effect And upon the latter Application
the said Court of Kings Bench were pleaded to say that they had nothing to doe with
this Matter but that the said Mr. Colley must apply for what she wanter to the
Sessions or to that or such like Effect and this Deponent further Saith that
the above named Defendt. is a Lady of above Seven Hundred pounds a year as this Dept.

Sworn has hard and believes
in Court at Justice hall in the Old Bailey the
24th day of February 1747
