At the General Quarter Session of the Peace of our Sovereign Lord the
King holden for the County of Middx at Hicks hall in St. John Street in the
County aforesaid by adjournment on Tuesday the fourteenth day of July in the
twenty first year of the reign of our Sovereign Lord George the second King
of Great Britain Etc.

Upon hearing of Mr. Serjeant Hayward and Mr Ellis Bishop of Councell for Robert
Higley
< no role > and John Higley< no role > Mattsters Appellants against a Judgment
and Sentence given by Thomas Burdus< no role > and Peter Elers< no role > Esqrs. two of his &
Majesties Justices of the Peace for the County of Middx for a forfeiture
of Eighty one pounds and ten Shillings mentioned to be incurred by
the Appellants for hiding and concealing from the sight of the
Officer a quantity of wetted Barley in order to the making into Malt
mentioned in their appeal It was alledged that notice was given on the
seventh day of July instant to Mr. Edward Whinfield upon whose
information the said Judgment was given that the said Appellants
intended to appeal to this Court on this present Tuesday the fourteenth
day of July instant at ten of the clock in the forenoon against the
said Judgment and Sentence And it was alledged that the said Edward
Whinfield
< no role > consented that the said appeal should be heard the same
day And that the said Appellants with their Councels and Witnesses
do now accordingly attend this Court and It was further alledged
that Mr. Glanvill had Yesterday being the first day of this Quarter
Sessions moved this Court as Councel for the said Mr. Whinfield without
any notice given to the Appellants and obtained an Order that the
hearing of the said appeal should be adjourned and that the same
should be heard by this Court on Fryday next and it was prayed And
this Court doth accordingly Order that the said Edward Whinfield< no role >
do pay unto the said Appellants or one of them their costs of this
days attendance on this Court with their Councels and Witnesses
before the hearing of the said appeal unless this said Edward
Whinfield
< no role > do upon notice hereof shew unto this Court good
cause to the contrary.
