Prosecutrix in this Cause, and her said Husband have been
parted and lived asunder for several Years past, as in the
Affidavit hereunto annexed,
That this prosecucon has been carryed on agt. the Deft.
without any Privity or Direccon of the Husband, and that he
knows not or ever heard any thing about it.
That the Deft. appeared at the last Sessions and plended
not Guilty; but since that Sessions, the prosecutrix & Deft. [..]
have agreed, and Wittnesses here to prove it, and has also
executed a Release (in her Husbands absence) to the Defendt.
Which, tho' not regular in Law, may show the Intencon of the
Party, and that the party has done us much aswhatwas in her power
to doe in this Affair in Absence of her Husband
I is therefore hmbly prsumed that in Case ye Indictmt
cannot be Discharged; yet the Recognizance of the Defendt.
may be so far Respited (in this Case) as to save the Baill Etc
