Oath and Saith that on Fryday last this Depont. Served the abovenamed
prosecutrix with a Notice of Tryall in the above Cause for Monday last
And the prosecutrix refused to accept of the Same, And this Depont. Sayes
that it was Agreed upon a Meeting had between the Said parties on
Tuesday last that Releases Should be Executed between the Said parties on
the Wednesday after at twelve of the Clock at Noon which Said Appointed
Meeting was put off till Six of the Clock in the Evening of the Same
Wednesday when all parties o behalf of the Defend Attended and was
ready to compromise the Same, But one Disuey reke acts as Sellicilor for
the said prosecutrix did not meet till ten of the Clock the Said Wednesday
Evening and then the Said Prosecutrix was not to be found and this Depont
Says that the Defendts was ready and willing to Try their Cause this Sessions
and Accordingly this Depont. paid Mr. Clennol one of the Clerks of this Court
for the Veinre in Order to try the Same And this Depont. lastly Says that
he Apprehends the Severall Appointments and Meeting abovemenconed
were made and had on purpose to prevent the Defendts. from Trying
their Cause This Sessions.
