WHEREAS this Court hath been informed, that a Tryal hath been had before the Right
Honourable the Lord Chief Justice of His Majesty's Court of King's Bench, at the Sitting
after Michaelmas Term last in Middlesex in an Action depending in the said Court between
Thomas Robe< no role > and John Matthews< no role > , Esqrs ; Clerk of the Market of His Majesty's Houshold,
Plaintiffs, and Richard Norwood< no role > Defendant, to try whether the said Clerk of the Market hath and Juris
diction out of the King' s Palace and the Precincts thereof, commonly called the little Virge, and whether he
is intituled to any and what Fees for viewing and examinning of Weights and Measures: and that upon the
said Tryal It was found thet the said Clerk of the Market hath a Jurisdiction beyond the little Virge, (viz.)
through the Circuit of twelve Miles from the Palace where His Majesty Shall be resident for the Time
being (except within the City of London) And that he is not intituled to the Free of four Pence twice in the
Year of viewing or examining of Weights and Measures. Now for the better Information and Direction
of all Persons concerned: And to the Intent that the said Clerk of the Market or his Successors, or his or their
Deputies or Agents may not exact, take or receive of any Person or Persons within this County upon Pre
tence of viewing examining or weighing of their Weights or measuring of their Measures any greater or other
Sum or Sums of Money then ought to be taken. It is ordered by this Court that it be; and it is hereby
recommended and referred unto His Majesty's for this County, re [..] ing within the [..]

[..] or to Clerk of the Market for the Time being, or his or their Deputies or Agen [..] of any [..]
Persons within the said respective Divisions other than the legal Fee or Fees: And to prevent all Doubts
and Disputes and all Extortions and Oppressions within their respective Divisions, under Colour of executing
the said Office of Clerk of the Market, The Justices of the Peace of this County now assembled in Quarter
Sessions, do declare it to be their Opinion, That the Clerk of the Market for the Time being is intituled
to a certain Fee (which he claims to be four Pence) for and on his making or Sealing any Weights or Measures
used for Gain in Trade or Dealing; But that no Fee is due to him for viewing or examining them without
Sealing or marking or for the reviewing resealing or marking again any Weights or Measures before marked or Sealed
by him or any preceding Clerk of the said Market: And it is further declared to be the Opinion of the
said Justices now present in Quarter Sessions, that no Person or Persons are oblidged or compellable to have
any of their Weights or Measures marked or Sealed by the Clerk of the Market, unless they shall think fit and
desire to have the same sealed or marked accordingly for their own Security or Satisfaction; and in Case that
they shall not desire or agree to the same, that in such case the Clerk of the Market has no Power or Autho
rity to demand, receive or exact any Fee whatsoever from them: And it is also the Opinion of this Court,
That the Clerk of the Market of the King's Houshold for the Time being his Deputy or Servant, is to carry
his Standard Weights and Measures to the Dwelling Houses, Shops or Stalls of such Persons as buy or sell
by Weight of Measure in their respective Traders or Callings in Order to view and examine the same: And
that no Persons whatsoever are obliged or compellable to carry or send any Weights or Measures to any Office
House or Place to be appointed for that Purpose by the said Clerk of the Market; But this Court is
likewise of Opinion that the said Clerk of the Market where he finds any false Weights or Measures
used in Trade or Dealing may feize, break or otherwise destroy the same; and may summon a Jury or
Juries and set such Fines on the Offenders as are proper and reasonable and aggreeable to Law; and it is
further ordered by this Court that a Copy of this Order to sent to every Divisions in this County.
