Justices at Westmr. from the day of St. Michael in
three weeks to satisfy Unto Roderick Mackensie< no role > for Mackenzie
four hundred thirty one pounds three pence &
one farthing debt and alsoefifteen shillings
fifty shillings for damages Etc whereof he is
convicted Etc And upon hearing ofwhat was
alledged by
the said William Mackensie< no role > This name instance is in set 4107. & his
Councell alledgeing that there was a long accompt
depending between the said William Mackensie< no role >
& Roderick Mackensie< no role > in relacon to some
dealeings between them in the way of trade,-
and [..] And that the Judgmt. upon which the sd. writt
of Capias ad satisfaciend was sudd out
was but lately entred Up by Vertue of a-
Warrant of Attorney given a great many
yeares since by the said William Mackensie< no role > This name instance is in set 4107.
That soon after the way the sd [..] the sd Roderick Mackenzie< no role > give
a Declarater of [..] same to the sd William Mackensie< no role > thereby [..]
in order to Secure the paymt. of such moneys
the [..] on the [..]
that which money should appeal due by any [..]
as might appearce to be due from the sd william< no role >

that that accompt on which the sd [..] & abead had been given Should be
to the sd Roderick Mackensie< no role > Upon the ballance
without prejudge to any former accompt
of the accompt between them,And that the-
the moneys due from the said william< no role > to the
said Roderick< no role > (for which the sd Judgmt. stands
as a security) doe not amount to the sume

the said William< no role > haveing paid a great many
