The traverse of John Broster< no role > Junr . upon an Indictmt. prferred & found against him(who was Indictedat
the last Generall Quarter Sessions of the peace holden for this
County for an assault by him made upon Conquest Lugar (to which
Indictmt. the sd. John Broster< no role > then pleaded not guilty)
being now called in order to be tryed, and a Jury being
[..] impannelled & sworne for that purpose It was
alledged that the sd. John Broster< no role > & Conquest Lugar
are both of them Boys And that it may be proper that
the matter in difference should be left to the determinacon
of Arbitrators to be nominated for that purpose rather then that this Court should be troubled And
Councell on both sides consenting This Court to the intent
that the said matter may be determined by arbitracon
Is of opinion that noe obidence be given on the sd
Indicmt. against the sd. John Broster< no role > whereby he may
be acquitted, And Doth Order that it be And It is
hereby recomended & referred unto Thomas Pindar< no role > &
Matthew Hewitt< no role > Esqrs . two of his Maties. Justices of the peace
for this County of arbitrate & determine the matters in
difference between the said parites, and to make their
Award in writing under their hands touching the premisses on or before
the fourthteenth day of January now next ensueing And that Bonds
of Arbitracon in fourty pounds penalty be entred into for
that purpose by the Fathers of the sd children to Oath other
for the due observance & performance of the Award of to be
made by the sd. Arbitrators as aforesaid, And noe accon is
to be brought by in the meantime by either of the parties for
or an attempt of the assault in queon,
