The Indictment Setts forth that Said Defte Smith
with one James Walker< no role > Another Defte did on the 31
of August last in the precinct of St. Ketherines in this
County by divers false to deus and pretences diddefraud
Morgan Lamport< no role > of the Same of £5:5s:0

Case


The Defte Walker pawn's apeice of Holland to the other Defte Smith
for £5, Walker comes to Smith And tells him there will be a woman
come with him And will lay downe the £5 for how the said
Walker to fetch the holland out of pawne, But Says Walker
this woman that will come owes me a good deal of money
when she lays downe the money Says Walker I will less up
the Money and I will give it you and there you receive
no money of her and as she did not pawne the goods Smith
was not Safe to deliver the goods to nobody but Walker

Upon which one Herne who was to have laid downe the
money as above brought came with the prosecutors Lamperts
wife and she laid downe the money and really was Servd
as above

The now Defte Smith hath had an Occon brought agt how for the
money and also this Indictmt and hath paid the prosecutor £10
but this Indictmt being upon the Oyer durst not confes it
so the prosecutor will not Appeare and be [..] given a release
