he this Dept. haith made Diligent Enquiry after
the prosecutor in this Cause in Ordr. to give him
Notice that ye Deft. Intended to appear & plead
Guilty to the Indictmt. he had prferred agt. him for
a Misdeamenor But was Informed by severall
people as well as by Mr Pidgeon Sollicitor in
this Cause that the prosecutor was at his house
in the Country & would not be in Towne these
Tenn Dayes & therefore refused to take such
notice as aforesd. altho Offered to him
