9th September 1773

Inches in Length from the West End of the said Timber Building and in
which part of the said Building is Erected, Ann of opinion the said 19 Feet 6 Inchs
is the old Boundary Wall of the Prison and the Property of the County And am
further of Opinion that the East End of the said Wall being 23 Feet 6 Inches
in Length is the Property of the aforesaid Mr Nightingale, it standing whotely
on his Ground.

That Mr Robt Palmers< no role > the other Surveyors opinion is as follows vizt
Septr 16th. 1773 Made a Survey of the Boundary Wall on the South Side of the
Garden belonging to New Prison Clerkenwell do Judge from the appearance
of the same to have been built prior to the other adjoining Buildings and do
likewise Judge was built as a boundary or fence Wall to the same as it is but
few Years since the first Builder had any right to Set half the Boundary or
Fence Wall on the adjoining Party's Ground and therefore do give as my
Opinion the said Wall belongs to the Prison

And that it is the further Opinion of the Committee upon a very minute
View and inspection that the said Boundary Wall, is the property of the
County as mention'd in the last Report of the said Committee

And the Committee further Report

That a new Building used as a Smelting House, has been lately
erected on the East Boundary belonging to the County Estate in Clerkenwell
and the proprietor of the said Smelting House has erected the West part of.
the said Building on the said Boundary Wall which Erection the Committee
conceive to be an encroachment

Which Report being Read This Court doth agree to the said Report and
doth ratify and confirm the same and the said Report is hereby in all things
Ratified and confirmed accordingly.

It is ordered by the Court that The Clerk of the Peace do acquaint the proprietor
of the Smelting House mention'd in the Report of this Committee with the
opinion of the Committee respecting the same and do give him proper Notice to
remove the same.

It is ordered by the Court that the Clerk of the Peace taking Mr Rogers to his
Assistance do examine into the State and condition of the Quakers Workhouse
and do make a Report of the same on the County day of next Session
