the said High Constable & Petty Constables & Headbrog. should make
diligent search throughout the said Division from time to time on the
Lords Day during the Summer Season for the effectual Suppressing
of the said evil and apprehend all such persons as they
should find practising such Gaming or guilty of any Riot or
breaches of the peace and should bring all such persons so
apprehended before them, or some of them or some other of His Majesty's said
Justices in order to their being dealt with according to law
And informed this Court that in obedience to the said
Warrant he and his said Assistants did apprehend and
take the before named Robert Crouch< no role > James Smith< no role > and Jas.
Duncan in the Evening of the said Sunday being Severally
found by them gaming and tossing up with Half Pence in
the said Division the same Day and that he caused them
to be secmed and left in the said Round House in the
Care and Charge of William Knight< no role > the keeper thereof and
John Acton< no role > of the Red Lyon in Twybourn Road a Constable
of the said Parish of St Mary le Bone to be there kept and
detained until they could be conveniently carried before
a Magistrate or Magistrates on the Marrow Morning to be dealt with according
to Law and the said High Constable further Informed this
Court that the said prisoners were set at large by the
said last mentioned Petty Constable and keeper or one of them
by the direction of the said Mr. Wrighte on the same
evening without causing them or either of them to be
had before him to be dealt with as the law required
and without examining the said Apprehenders touching
their charges against them for which they had been so taken
and without taking any Recognizance for their appearance
at the Sessions or good behaviour or otherwise Where upon
this Court doth Order that James Waller< no role > Esqr Clerk of the
peace of this County do Write a Letter to the said Mr.
Wrighte to desire him to dine with His Majesty's Justices
of the Peace for this County on the County Day of the next
Session and then to answer to the said Matter of Complt.
against him and doth likewise order that the Said Wm.
Knight and John Acton< no role > do attend the Said Court on the
