These Opinions having been laid before the Court of Aldermen
they directed the Defendts. to attend at the next Court when the following
Proceedings were had.

This Day the Court took into Consideration pursuant to the
Order of the 19th. April last the Opinion of Mr. Recorder and Mr. Comr: Serjeant
relative to the Exemption claim'd (under the Act of Parliament of the 18th:of
his late Majesty King George the Second for making the Surgeons of London
and the Barbers of London two seperate and distinct Companies) by Jacob
Bonwick
< no role > and John Wills< no role > of the Ward of Vintry and also Willm: Vickery< no role >
of the Ward of Bishopsgate Citizens and Barbers from serving the Office
of Constable which Opinion was then delivered into this Court and read
and the same was now again read and the said Jacob Bonwick< no role > John
Wills and William Vickery< no role > attending were called in and acknowledging
that they had each of them receved a Copy of the said Opinion were asked
if they were willing to take upon them the said Office of Constable to which
they were elected on Saint Thomas's Day last they replied they still though
themselves exempt from serving the said Office and would not take upon
them the same unless compelled by Lace and then they withdrew

Resolved that it is the Opinion of this Court that the said Jacob
Bonwick
< no role > John Wills< no role > and William Vickery< no role > are eligible to the said Office
of Constable and doth not discharge them from the same.

Ordered that Mr. Philip Wyatt Crowther< no role > this City's Solicitor
do at this City's Expence prosecute the said Jacob Bonwick< no role > John Wills< no role > &
William Vickery< no role > for refusing to take upon them the said Office of Constable
to which they were elected on Saint Thomas's day last

The Exemption now claimed by the Defendant is perfectly
novel the constant and invariable Usage of every Ward in this City
militating against such Claim for upon examining the respective Ward
Beadles I find there never was an Instance of such Exemption being allow'd
or ever claim'd till the present Dispute but on the contrary that Persons so
circumstanced have uninformly served all Ward and Parish Offices
and it is worthy Observation that the present
