On an Indictment for a Nuisance
and Misdemeanor

John Pirner the abovenamed Defendant and John Biddle< no role > of
Bridge Street Blackfriers Gentleman jointly and severally make oath
And first this Deponent John Priner for himself Saith That the matter of the above
mentioned Indictment being at Issue and standing for Tryal at this
present Sessions he this Deponent caused a Subpana to be sued out
directed to William Neville< no role > of Ship Court in the Old Bailey London late
Servant to this Deponent and others to appear and given Evidence on
behalf of this Deponent on the said Tryal and to be delivered to the
other Deponent with Directions to Serve the said William Nevill
therewith And this Deponent the said John Biddle for himself
Saith that at the request and device of the said other Deponent he
the Deponent did on Fryday last make enquiry after the said
William Nevill at his usual place of Residence in Ship Court in the
Old Bailey London in order to serve him with a Subpana to appear
and give Evidence of behalf of the said other Deponent on the tryal
of the said Indictment at this Present Session and Saith upon such
enquiry was informed by the Wife of the said William Nevill that
on Monday last the said william Nevill went to Salisbury on his own
private Business and woud not return in less than a fortnight and
which Information this Deponent verily believes to be true And this
Deponent John Priner for himself further Saith that he hath and his
utmost endeavours to find out and Subpana [..] the said William Nevill
to give Evidence on behalf of him this Deponent on the Tryal of the
said Indictment but has not been able to find him And Saith that
the said William Nevill is a principal and material Witness for
him this Deponent on the said Tryal without whose Testimony this
Deponent cannot safely take his tryal on the said Indictment And
