judgment of death.

5 Margaret Caroline< no role > , wife of Valentine Rudd< no role > , standing indicted for feloniously forging,
counterfeiting, uttering, and publishing a certain paper writing, purporting to be
the bond of William Adair< no role > , Esq ; in the penal sum of 10,600l. conditioned for
payment of 5,300l. with intention of defraud the said William Adair.Also for
publishing the same with intention to defraud Thomas Frankland< no role > , Bart .

Also indicted for feloniously forging, counterfeiting, uttering and publishing as true, a
certain paper writing purporting to be the bond of William Adair, Esq; in the penal
sum of 12,000l. conditioned for payment of 6000l. with intention of defraud the
said William Adair; and also for feloniously forging, counterfeiting, uttering and
publishing the same as true, with intention to defraud the said Thos. Frankland, Bart.

Also indicted for feloniously forging, counterfeiting, uttering and publishing as true,
a certain paper writing purporting to be the bond of William Adair, Esq; in the
penal sum of 6,200l. conditioned for payment of 3,100l. with intention to defraud
the said William Adair; also fro feloniously forging, counterfeiting, uttering and
publishing the same as true, with intention to defraud Thomas Brooke< no role > , doctor in
physic .

Also indicted for feloniously forging, counterfeiting, uttering and publishing as true,
a certain paper writing purporting to be the bond of William Adair, Esq; in the
penal sum of 15,000l. conditioned for payment of 7,500l. with intent on to defraud
the said William Adair: and for feloniously forging, counterfeiting, uttering and
publishing the same as true, with intention to defraud Thomas Drummond< no role > , Esq ;
and Robert Drummond< no role > , Esq ; Is, on the affidavit of the said Margaret Caroline
Rudd and Thomas Parker< no role > , of the absence of a material witness, and also of the
belief of the said Margaret Caroline of the said Valentine Rudd's death, and the
shortness of the time to get sufficient evidence thereof to prove the same on the
plea she may be advised to plead to the said indictments. ordered to remain.

6 Thomas Wright< no role > , indicted of feloniously assaulting Margaret Child< no role > , an infant about the
age of 11 years, and feloniously ravishing and carnally knowing her against her will;
is, on the indisposition of the said Margaret, ordered to remain.

7 John Yardley< no role > , acquitted last session of traiterously coining and counterfeiting the silver
coin of this kingdom called shillings; but it appearing to the court that he feloni-
ously and traiterously had in his custody and possession a certain flask and instruments
proper to counterfeit the coin of this kingdom, ordered to remain.

8 David Roche< no role > , committed by the Right Hon. the Earl of Rochford, one of his Majesty's
principal secretaries of state; his Grace the Lord Archbishop of Canterbury; the
Right Hon. Lord Apsley, Lord High Chancellor of Great-Britain; his Grace the
Duke of Queensberry and Dover; the Right Hon. Charles Lord Spencer, and the
Right Hon. Lord North, lords of his Majesty's privy-council, on his examination
at the council-board, on the information of John Wordie< no role > , Andrew Cairncross< no role > ,
and Robert Young< no role > , on a vehement suspicion of feloniously and wilfully, with
malice aforethought, murdering John Fergusson< no role > at the Cape of Good Hope , on
the coast of Africa , without his Majesty's dominions: and the said David Roche
having confessed that he killed the said John Fergusson, ordered to remain.

9 Thomas Beets< no role > , convicted in April session of killing and slaying Dorothy< no role > his wife ,
otherwise Dorothy Day< no role > , widow , was branded in the hand, and ordered to be im-
prisoned 6 months.
