Indictment for a Fraud

Jonathan Walklett< no role > of the Parish of Saint Jamesm
Westminster in the County of Middlesex Gentleman an and Abraham Judah< no role >
of Chiswell Street in the County of Middlesex Colourman the Defendant
abovenamed severally make Oath as follows and first this Deponent
Jonathan Walklett< no role > for himself saith that he this Deponent did on the
first day of July instant Go to the House of Lyon Levy< no role > in Hanover
Court Hounsditch Merchant and enquired for the said Lyon Levy< no role > in order
to serve him with a Writt of subporna to Attend and Given Evidence on
behalf of the other Deponent Abraham Judah< no role > the Defendant
abovementioned on the Tryals of the said Defendant at the next General
Session of Oyer and Terminer to be holden for the City of London at Justice
Hall in the Old Bailey on Wednesday the Sixth day of July instant and
this Deponent was informed by the sd. Lyon Levy< no role > 's Wife that he the said
Lyon Levy< no role > was then abroad beyond the Seas at Hambrough but that
she believed and expected that he the said Lyon Levy< no role > would return
home and arrive in England in about one Months time or to that or
the like Effect and which Information this Deponent verily beleives to be true And this Deponent Abraham Judah< no role > for himself
saith that the said Lyon Levy< no role > is a very material Witness for this
Deponent in the above Cause and without whose Evidence this
Deponent cannot, as he is advised and believes safely proceed
to or make his Defence on the Tryal of the said Indictment against
this Deponent and this Deponent further saith that he the said Lyon
Levy hath been gone abroad ever since the month of April last as this
Deponent hath been informed and verily beleives and this Deponent hath
since been informed and which he believes to be true that he the said
Lyon Levy< no role > will return and is expected home to England in about
a Months time and this Deponent Jonathan Walklett< no role > saith that he did
on the second day of July instant serve Francis Smith< no role > with a Copy of a
Notice in Writing subscribed by the said Abraham Judah< no role > purporting
that this Court would be moved as this day that the Tryal of the Transverse
on the Indictment preferred by the said Francis Smith< no role > against the
said Abraham Judah< no role > for a Fraud might be put off to the next
following Session by delivering a true Copy of such Notice
