Albert Innes< no role > of Gold Square Crutched Fryars London Esquire
the Prosecutor in this Cause Maketh Oath that the Defendant
abovenamed is indicted for Feloniously personating one Andrew
Magee
< no role > late a Seaman belonging to His Majesty's Ship the
Burford in order to receive certain Prize Money belonging to the
said Andrew Magee< no role > for his Service on Board the said Ship and
saith that Although the said Defendant did at the time he was
detected acknowledge and confess that his Name was not Andrew
Magee yet this Deponent is advised That it will be necessary
notwithstanding such Confession upon theTrial of the said
Indictment to produce some Person belonging to the said Ship who
Knows the said Andrew Magee< no role > and can prove his Service on
board the said Ship and that the said Defendant is not the Person
and that without such Testimony it will not be safe to proceed
upon the said Trial and saith That he this Deponent is not
prepared with such Evidence at this Session Although he has
used his utmost Endeavours for that Purpose but saith that he
has no Doubt and verily believes he shall be able to produce
sufficient Evidence in that Respect at the next Session of Gaol
Delivery to be holden for the City of London.
