Deponent Copartners and together with the other Deponent gave Evidence to the Grand Jury [..]
thereon And Saith that the bill being found he applied for and obtained a warrant from this
Honourable Court yesterday morning to take the said Defendant (their at large about his
Business being a labouring Man at Mr. Deputy Greggs) And between twelve and one
o'Clock yesterday afternoon caused him to be brought into this Honourable Court to be
anaigned And when he had so done went away in order to attend the tryal with the other
Deponent and returned again about seven o'Clock last night and again this Day before
the Sitting of the Court in order to attend the tryal when he was informed to his great
surprize that the Defendant was tryed and acquitted for want of prosecution so early as
three o'Clock yesterday afternoon and the Deponent Lawrence Yeates for himself saith
that the defendant Gregory having offered the two Nails at his Shop for sale he stopt him and
gave the prosecutor notice and likewise attended and gave Evidence thereof to the Grand
Jury and the bill being found he by appointment made with Mr. Hilton the prosecutor
left word at his House that he was attending his Company (where he was engaged) at
Pewterers Hall in order to be found to give Evidence whenhethe Defendant should be
taken up and (not expecting he would be tried before) this morning called at Mr. Hilton
and from thence came to the Honourable Court to attend and give Evidence on the tryal
which he was very willing to do for the Sake Justice and was greatly disappointed
when he found the Defendant had been acquitted And lastly both the Deponents for
themselves severally say that they did not omit or delay appearing against the said
Defendant but entirely through ignorance of this kind of Business.
