Walter Pencutt< no role > of the parish of Saint Andrew Holborn in the County of Middlesex
Coachman maketh Oath that on the first day of January last he had his pockett
Picked of a Handkerchief near the Fleet Market London and Suspecting one
John Beal< no role > to have Committed such offence this Deponent Caused him to be
apprehended and Charged in Custody of a Constable or peace officer who
on the next day Carryed him before the Rt. Honble. the Lord Mayor in
order to be Examined touching the Same when and where this Deponent
appeared and Entred into a Recognizance of ten pounds to prosecute the
said Beal at the then next Ensuing Sessions at the Old Bailey and thereupon
the said Beal was Committed to Newgate And this Deponent then
Inquiring when the said Sessions would be held was Informed by the said
Constable , that it would not be untill the then Wednesday Fortnight
which Information this Deponent relying on to be true did not appear
at the said Sessions in due time by which meanes the said Beal was
Discharged for want of prosecution and this Deponents Recognizance
become for fected as he hath since head and beleives And, this Deponent
further Saith that he would have appeared and prosecuted the said
Beal in due him had it not been from the Information he so
received from the said Constable which he hath now Discovered
to be a Mistake for that the said Sessions happened a week Sooner
than the time mentioned to this Deponent by the said Constable and Lastly this
Deponent Saith that the neglect of prosecuting the said Beal was occasioned
merely from the wrong Information above mentioned and from no other Cause
whatsoever
