On the prosecution of Caleb
Reynolds for an assault

Diconysius Callaghan< no role > of Sweetings Alley London Gentleman
Maketh oath that on or about the Twenty Seventh day of March last
this Deponent entered with one Thomas Lyon< no role > each into a Recognizance
of Ten pounds for the personall appearance of the above Defendant John
Callaghan
< no role > at the then next ensuing Sessions of the peace to be held for the
City of London to Answer the Complaint of the above prosecutor Caleb Reynolds< no role >
and that upon finding on Indictment of Common assault being found at the
said Sessions against the said John Callaghan< no role > for the said Offence on the prosecution
of the said Caleb Reynolds< no role > this Deponent applied to the said Dependant John
Callaghan and desired him to Compromise and agree with the said prosecutor
which said Depondant promised to do and which afterwards the said
Dependant told this Deponent he had done which this deponent believes was
true and that he the said Defendant made Satisfaction to the prosecutor
for the said assault and is strengthend in such his opinion and belief for that
no process whatsoever was ever taken out subsequent to the finding the
said Indictment to Compell said Defendants appearing thereto as he has
been (Well Informed and believes to be true And this Deponent further Saith
that said Depondant sometime after having occasion to go beyond Seas into
Foreign parts about his own Business but not with a design of absconding
from Justice or not appearing to the said Indictment and no appearance
being entered to the said Indictment nor the said Indictment being Discharged
this Deponent last week and at Severall times before caused S [..] Several
and Enquiry to be made at the abide of the said prosecutor in order that he
might attend this Honourable Court and Satisfy the said Court of the
Truth of the Premisses and Consent to the resputing of the said Recognizance
or otherwise as to the Court should seem meet and this Deponent saith
that he was Credibly Informed by a person employed to make the said
enquiry (and verily believes) that the said presecutor was gone to sea
and s now absent out of this Kingdom and that it is very uncertain when
he shall return And this Deponent farther saith that the said
Defendant John Callaghan< no role > is Expected home in London in less than
a Months time
