John Delafont< no role > of the Middle Temple London Esquire the prosecution
in this Cause maketh Oath and saith that the Trial of this Indictment
hath been put off several Sessions at the Defendt. Walkers Requested
and not one at this Deponent's Instance and that he this Deponent
did at one time consent to its being put off at the said Defendant
Walker's Instance, being moved thereto by the Tears and Intreat [..]
of his the said Walker's Wife even after his Witnesses had been
Subana'd his Councill instructed and other preparations made forth
Trial, and saith that the said Walker hath within there three weeks, this Ten nights
applied to be forgiven and to ask this Deponents Pardon and that the
said Walkers Wife also hath several times made Application to this
Deponent for the like purpose And further saith that he could [..]
be prepared to prosecute the said Defendts. at this Session by Reason
that he does not know where several of his material Witnesses her
and that Mr. Bridgen this Deponents Agent in this Prosecution
who subpeena'd his said Witnesses as aforesaid and knows where
they live is now and hath been for this Month last past as this
Deponent hath been informed and believes out of Town and will [..]
return under a Month more
