on the Prosecution of John Payne< no role >

Robert Patterson< no role > of Shovel Alley Woodstreet in the parish of St. Michael Woodstreet
London Linnen Glazer maketh Oath and saith that on or about the Sixth day of November
last he become bound by Recognizance for the Appearance of the said Thomas Powell< no role >
at the then next Session of the peace to be holden for this Honourable City to answer the
Complaint of the abovenamed Prosecutor (which the said Powell faithfully promised
to Perform Accordingly without this Deponent's having Occasion to give himself any
further Trouble about it And this deponent verily beleived he would) who having caused
an Indictment to be found against the said Powell at the said Session held in december
last, for Assaulting him at a Public house in Woodstreet over their Liquor and the said
Defendant not appearing to answer thereto as this deponent was afterwards inform'd
and that thereupon his this Deponent's Recognizance was become forfeited This
Deponent hath ever since such Information used his utmost Endeavours to find and
bring the said Defendant to answer the aforesaid Indictment but without Effect hitherto
(The Defendant having Adsconded merely on Account of some debts which he could not satisfy
as this Deponent was Informed) yet he is Still in hopes he shall be soon able to take the
said Deft. to that end And will use his utmost Endeavours so to do And Lastly this Depont.
saith that on Thursday the twenty fifth day of October Instant upon his this Deponent's
application to the Prosecutor for his Consent that the above mentioned Recognizance might
be Respited by this Honble. Court. He the said Prosecutor consented & told this Deponent
(us he had done several times before) that he would not that this Deponent should come
into any Trouble Account of the aforesaid Engagement for the Defendant provided
this Deponent would cause him to be apprehended when it shall be in his Power
which he Promises to do as above
