Gentleman and William Davis< no role > one of the Clerks in the Navy Office
severally make Oath and Say And first the said Charles Massey< no role > for
himself saith That by the Orders and Directions of the Right
Honourable Henry Fox< no role > Esqr Secretary at War he this Deponent
is carrying on a Prosecution against the abovenamed John Dailey< no role >
als Peterson< no role > als Gahogan< no role > for Forging and Publishing a Letter of
Attorney in the Name of John Barnes< no role > as the Brother and Administration
of Robert Barnes< no role > a Marine in Colonel Torrington's Regiment and
late of his Majesties Ship Ruby And this Deponent further saith
That on the Trial of the said Prosecution this Deponent Apprehends
it will be necessary To produce the Pay books belonging to his Majesties
Ship the Ruby and that without the said Books it will not be safe
to preferr the Bill of Indictment to the Grand Jury and to
proceed to the Trial of the said John Dailey< no role > alias Peterson alias
Gahogan And this Deponent William Davis< no role > for himself saith
That the Pay Books belonging to his Majesties Ship the Rubey
are now and have been for these Six Weeks past and upwards at
his Majesties Dock Yard at Plymouth and are now made Use
of there for paying off the Recalls on the said Ship And this
Deponent saith that he apprehends are believes that the said Books may be
returned to the Navy Office in London by or before the next Sessions
to be held at the Old Bailey in and for the City of London .
