Solicitor for William Wood< no role > the Prosecutor Maketh Oath and Saith That
the Major part of the Commissioners in a Commission of Bankrupt
awarded against the said Peter Comerlan< no role > having met in September
last at Guild hall London pursuant to an order of the right honble
the Lord hight Chancellor of Great Britain upon a Petition of the said
Wood's for that Purpose the said Wood did before such Commissioners prove
a debt due to him & his Partner John Michell from the said Peter
Comerlan and thereon this Depot. did by the said Wood's order Lodge a
petition in his & his said Partner's Names to the Lord Chancellor setting
forth to the Effect following (that is to say) That in or about May 1749
a Commission of bankrupt issued against the said Comerlan under which
several Proceedings were had which Commission & Proceedings had not
been Enrolled with the Proper Officer And that the said Petitioners being
desirous the said Commission & such Proceedings as were mentioned in
their said Petition might be Enrolled And that Mr Unwin who acted as
Clerk might bring and leave the same with the Proper Officer to be Enrolled
(That is to say) The said Commission of Bankruptey the Deposition or
Depositions of the Witness or Witnesses that proved the said Comerlan a
Bankrupt The Deposition of the proof of the Petitioning Creditor's debt
the Several Entries made by the Several Comissioners of their several
Meetings under the Said Commission and of the Bankrupts Surrandring
or not Surrendring at Such meeting or Meeting's respectively The Several
Summons issued by the said Commissioners or the Major Part of them
to give notice to the Bankrupt to Surrender himself to the said Comissioners
according to the Several Acts of Parliament for that Purpose Etc the
several deposition or Depositions of the Person or Persons that served
the Summons and that Thomas Newton< no role > the Petitioning Creditor having
Exhibited Several notes under the said Commission And therefore praying
his Lordp would please to Order that Mr Unwin the Clerk of the said
Commission & the said Newton might be obliged to produce & leave all
the aforementioned Commission & Proceedings & the said Notes with
the Proper Officer to be Enrolled at the Expence of the Petrs. On which
Petition His Lordship was Pleas'd on the 30th. day of September last
