James Needham< no role > }
Convicted last October Session in London
and Transpted

John Tookey< no role > of Watling Street London Bricklayer maketh
Oath and saith that in the Month of October last he being present
when the abovementioned James Needham< no role > was detected in stealing
an Handkerchief out of the Pockett of Mr. Isaac Gervaise< no role > he did (for the
sake of Justice to the public) give his Assistance in pursuing and taking
him and when he was taken he this Deponent advised Mr. Gervaise to Prosecute the Law against him and accordingly went withthe Prosecution
him before the Sitting Alderman at Guildhall and entered into a Recoginz
to Appear at the then next Session of Gaol Delivery of Newgate
to give Evidence against the said Needham And this Deponent
further saith that pursuant to the Condition of such Recognizance
he attended and gave his Evidence to the Grand Jury at Guildhall in
October session last upon an Indictment against the said Needham
for the abovementioned Felony and likewise Attended afterward at
this Place on two Days in order to give his Evidence to the Honble
Court there on the Trial and did not on either of those Days hear
himself called fort that purpose nor could he see the Prosecutor Attending But
this Deponent hath been lately informed by the Prosecutor
that the Trial of the Cause came on very Suddenly and that
this Deponent was called to give Evidence against the Petrs.
(who notwithstanding this Deponents absence [..] and the want of his
Testimony, was Convicted as this Depont. is credibly Informed) And lastly
this Deponent Saith that his absence at that time was not by [..]
any wilfull Default or neglect but entirely thro' ignorance [..]
