and that the said Bond had brought his Action at Law against them the
following being the words of the said, Order as this Deponent beleives they
having been read to her as such Vizt. "The Defendant being Convicted of
"assaulting Joseph Gladman< no role >
Judgment is respited by this Court by Consent
"of all parties upon an agreement that Defendant should in Six Months
"from this true pay the prosecutor Seven Guineas during which time all
"further proceedings in this Court and elsewhere descending between
"the said parties should be stayed" And this Deponent further Saith that
her said husband Francis Elgar< no role >
being Obliged to pay so much Money
on Account of the said Action so Commenced and Carried on against him
and his Son William Elgar< no role >
by reason of such quarrell has rendered
him incapable of Complying with such Order as paying the said Seven
Guineas which otherwise he could and fully intended to have done
had not the said Bond contrary to his agreement entered into before
this Court prosecuted his said action against this Deponents husband &
Son and this Deponent John Brackin< no role >
for himself Saith that he did on
Saturday last Serve the prosecutor Gladman with a Copy of the notice
hereunto annexed marked (A) by delivering a Copy thereof to his
Wife at his house in Gallspur Street
but this Deponent afterwards
finding that there was a mistake in such notice so delivered to the said
prosecutors Wife on Saturday last which was that Francis Elgar one
of the Defendants Bail had signed the said notice instead of the
Defendant but this Deponent in Order to give the prosecutor timely
notice of such mistake did yesterday about 12 o'Clock at noon deliver
to the prosecutors said wife a Copy of the other notice hereunto also
annexed marked (B) signed by the said Defendant who said it was
very well and she would give it to her husband or to that effect
