The King agt: Devenish

James Barrbridge< no role > Agent for the prosecutor in this
Cause Maketh Oath that at the last Sessions held of
Justice Hall in the Old Bayly Thomas Devenish< no role > Pleaded
not Guilty to the Indictment Prefered agt: him and pat
in Bayle to by his Travers thereupon at this present
Sessions And this deponent did Expect notice of legal to be
given thereupon wch: as this Deponent apprehended was
necessary in cases of this nature but this Depont: Saith the hath
not exced any notice of legal & therefore did not [..] appri [..]
James Graham< no role > the prosecutor & most Material Witness in this
prosecution time enough for his Attend case upon the Sd. Prosecucon
And this depont: Saith he hath both Yesterday & to day done
his atmost endeavour to get the Sd. Graham to Attend but
he is not to be found And the depont: Saith he is a very
material witness & without whose Testimony this Indictment
cannot be safely brought to legal as this depont: apprehend
and is advised And this Dept.: Saith he did this day give
notice of Moron in writing to Mr. Salt the Defendants Solr.
in this Laws that the Court would be moved as of this day
that the by at of this [..] Indictment may be put off till
next Sessions.
