joyntly & sewally make Oath, And first the Sd.
Samuel Avery saith that he was sent this present day by
the other Dept. Millington to the house of Mr. Benjm. Osgood< no role >
to inquire for his Apprentice (who as this Dept. Avery hath
been informed & verily beleives is a materiall Witness in
this Cause) where this Dept. Avery was informed by the
Maid that he was very ill & had been gone into the
Country Sometime before & still remained there for his
Health And this Dept. Samll. Millington Saith that the
Sd. Apprentice of the Sd: Mr. Osgood is a materiall
Evidence in this Cause And that the Defts. cannot safely
try their Traverse without the Evidence of the Said
Apprentice.
