Upon an Indictmt
of High Treason

Barnaby Carroll< no role > Soll. for the Defendt. maketh Oath that
he this Deponent being Advised by the Defts Council to
Apply to the persons concerned in the prosecution on
this Indictmt for one of the Libells menconed in the said
Indictmt intituled Ex Ore two to Indico Voz Populi Vox
Dei did on or about the thirteenth day of this instant
October goe to Anthony Cracherode< no role > Esqr Sollicitor for
his Majties And told him then that he this Dept came
by the Direction of the Defts Councell to desire him to
let this Dept have one of the sd. Libells in order to Enable the
Defendant to make his Defence Whereinto the said Mr. Crackerode made
Answer that He cond not part with any of them without Orders Whereupon
the Said Defendants Council on Monday the Nineteenth Instant moved the
Court of Oyer and Terminer and General Goal Delivery at the Old
Bayly that the Defendant or the persons converned for him might
have the Sight of one of the Said Libell to Enable the prisoner to
make his Defence and acquainted the Court that Application had
been made to Mr. Crackerode for that Purpose but without
Success where upon the Said Court directed to apply properly And
thereupon this Depont on Tuesday the twenty Seventh Instant
went to Mr. Attorney Generals Chambers in the Temple and
acquainted his Clerk that this Deponent was Sollicitor for the
Defendant Matthew and came by the Direction of his Council
to wait on Mr. Attorney General in order to desire that the Defendt.
or the Persons concerned for him might have a Sight of one of ye
Said Libells in order to Enable him to make a proper Defence at
the Defendts. intended Tryall Whereupon Mr. Attorney Generals
clerk Said He woud go in and Speake to Mr. Attorney About it and
Accordingly went in to another Room and Soon returned and told
this Depoent that he did not apply properly Whereupon this Depont
replyed that if instead of applying by Word of Mouth Mr. Attorney
Expected He Shoud do it by petition in Writing he this Depont was
ready to do it to which Mr. Attorney Gents Sd Clerk to replyed yt
it was not his business to Advise him this Deponent And this
Dept further maketh Oath that yesterday about five o Clock
in the Evening Mr. Paxton who appears in this Prosecution cames
to this Deponents Chamber in the Temple & told this Depont
