liable to be Estreated into his Majesty's Court of Exchequer
for this Deponants not performing the Condition thereof

And this Deponant Thomas Dalton< no role > for himself
Saith that he was also bound by Recognizance to give
Evidence in the above Prosecution That he did on
Saturday the Twenty fifth day of April last acquaint
the above Prosecutor John Buckannan< no role > to attend the
Trial of the said John Eades< no role > in manner as is mentioned
in his Affidavit And that the said John Buckannan
acquainted this Deponant he could not possibly Attend
that Evening on Account of having no person to leave
the Management of his House to and that if the Trial
did come on the said John Buckannan< no role > begged this
Deponant to acquaint the Court of the reason of his
absence and his situation And this Deponant Saith
that when the Trial of the said John Eades< no role > was
called on he this Deponant day acquainted the Court that the Prosecutor could not attend for
the Reasons aforesaid but did not represent to the
said Court that the said Prosecutor would not Attend
And the said John Buckannon Attended on the Monday
following for the purpose of giving Evidence against
the said John Eades< no role > but was too late as the said John
Eades
< no role > had been Tried and Acquitted And this
Deponant Saith That on the Tuesday following the
said John Eades< no role > was Tried and Convicted for another
Felony for which he was then in Custody
