Sheriff of the said County of Kent in whose Custody in the said
Goal for the Cause aforesaid he had been before Committted And
being brought to the Bar herein his own proper person is
Committed to the said Sheriff forthwith Convenience the
premises in the said Indictment specified And being as he
by the Court herein what manner he would be Acquitted
thereof he the said Robert Smith< no role > saith that he is not Guilty
thereof and Concerning this for Good and Ill he puts himself
upon the Country Therefore Late Jury thereupon
immediately come before the said Justices last named
and others their Fellows Justices as aforesaid here who are
not of Him to the said Robert Smith< no role > to recognize upon their
Oath whether the said Robert Smith< no role > is Guilty of the Felony
and Burglary in the Indictment aforesaid above specified
or not. And the Jurors of the said Jury by the said Sheriff to
this Matter Impannelled and returned to wit Joseph Cox< no role >
Henry Cox< no role > James Fremlin< no role > Richard Mullins< no role > Thomas
Rolfe
< no role > Richard Treadwell< no role > John Middleton< no role > John Rogers< no role >
Thomas Diamond< no role > Francis Buley Joseph Whiting< no role > and
Thomas Brazier< no role > being called come who being Elected Tryed
and Sworn to Speak the Truth of and Conceiving the premises
aforesaid Do say upon their Oath that he the said Robert
Smith
< no role > is not Guilty of feloniously breaking and Entring
the Dwelling house in manner and form as in and by the
said indictment supposed and Charged him But that
he the said Robert Smith< no role > is Guilty of Stealing the Goods
and Chattles of the said Matthew Butler< no role > in the said
Dwelling House then and there being found And that the
at the Time of the Commiting the said Felony or at any
time since had not hath any Goods a Chattles Landson
Tenement in the said County of Kent or elsewhere to the
Knowledge of the said Jurors And thereupon it is
forthwith Demanded of the said Robert Smith< no role > if he hath
anything to say for himself why the Court there should not
proceed to Judgment and Execution against him upon the
Verdict aforesaid nothing further Sayeth than what the
had before said Whereupon all and Singular the premises
being seen and by the Court herefully understood It is
Ordered by the Court there that the said Robert Smith< no role >
