Judgmt. of Now Suit was Entered thereon for want
of Prosecution And it further appearing to this Court
that the sd. Mathew Kenney< no role > havingdid in January
Session 1770 reced Judgment to be hanged by the
neck until he was Dead and afterwards that he
shod. be Dissected and Anatomized pursuant to
the Statute Etc And that afterwards on Application
to his Matie he was respited until the then
next Session And unto whom his Majesty was
graciously pleased to Extend his Royal Mercy
upon Condition of Transportation for the Term
of his Natural Life And being now Present at
the Baris Asked by the Court if he is willing to
Accept his Maties Mercy on Condition of
Transportation for the Term of his Natural
Life who agrees to Accept the same on the
Condition afd. And it also further Appearing to
this Court that the said Patrick Kennedy< no role > did in
Janry Session afd. receive Judgment to be hanged
by the Neck until he was dead and afterwards
that he shod. be Dissected and Anatomized according
to the form of the Statute Etc And that afterwards
application having been made to his Matie And
some favourable Circumstances Appearing onhis
his behalf he was Respited until this Present
Session unto whom his Majesty hath been
graciously Pleased to Extend his Royal Mercy
Upon Condition of Transportation for the Term
of fourteen Years And he being now Present at
the Bar is asked if he is Willing to Accept his
Majesty's Mercy on Condition of Transportation
for the Term of fourteen Years who agrees to
Accept the same on the Condition afd. It is
therefore Ordered by this Court that they
the sd. Mathew Kennedy< no role > This name instance is in set 2968. and Patrick Kennedy< no role >
be severally Transported to some of his Maties
Colonie and Plantations in America he the
sd. Mathew Kennedy for the Term of his Natural
Life pursuant to his Maties Pleasure
Signified by the Right Honble Thos. Thynne< no role >
Viscount Weymouth one of his principal
Secretaries of State And he the sd. Patrick
Kennedy
< no role > for the Term of fourteen Years
pursuant to his Maties Pleasure Signified by
John Dunk< no role > Earl of Hallifax one other of his
Principal Secretaries of Statute And it is [..]
further Ordered that they the said Mathew Kennedy
and Patrick Kennedy< no role > do severally remain
until they shall be so Transported
