this Day that he has made Strick Enquiery for his
Principal Evidence John Smyth< no role > in Order to Summons
him to appear Before this Honourable Court to testifie
and Give Evidence in Behalf of Depont upon his Pyal
and Dep hath [..] Dende woured to Subpana him but
in his Cause hath not been hble so to do and Deposeth the said John Smyth< no role > Deponth
Principal Evidence is Lately Gone to Bath in Sommerseld Shire
as Deponth. is Informed & Verily Beleives, Deponent further
Deposth. That he Cannot with any Safety to his Pson abide his
Tryal in this Cause without the Evidence of the aforesaid John
