for Felony on the same Prosecution

Richard Hunter< no role > of Tower Street London Tinman the Prosecutor of the
abovenamed Prisoners Maketh Oath and Saith that he did attend this Honourable
Court all Day Wednesday the first Day of this present Session and likewise all
Day Thursday from nine of the Clock in the Morning until past Eight of the
Clock in the Evening of the same Day And this Deponent not having had any
Kind of Refreshment all that Day and finding himself very faint and weak
for want of such Refreshment and being Informed by some Persons then in
Court (who were utter Strangers to this Deponent) that the Tryal of the said
abovenamed Prisoners would not come on to be Tryed that Night where upon
this Deponent quitted the said Court and did not returns again that
Evening by reason of the Information he had before received in Court as
aforesaid and about half an Hour past seven the next Morning (one
Thomas Chambers< no role > one of the Constables of the Parish of Saint John
Wapping this Deponents Witness on the said Indictments against the
above Prisoners) to this Deponents great Surprise Informed this Deponent.
that the said Prisoners had been tried the over Night and for Want of this
Deponents Appearance to prosecute were severally Acquitted And this
Deponent further saith had he suspected that the Tryal of the abovenamed
Prisoners would have come on that Night he would have returned again
after having received some Refreshment And this Deponent on his Oath
possitively Saith that it was then his firm Resolution when this Deponent
quitted the Court Thursday Evening to have prosecuted the abovenamed
Prisoners for the Felony whereof they then stood Indicted and would have
so done had not this Deponent been Misled by the Information he had
before received in Court as aforesaid And that this Deponent did not
desert the Prosecution of the abovenamed Prisoners or either of them out
of any favour or affection towards them or either of them any other
Motive whatsoever save as aforesaid
