James Waller< no role > Esquire Clerk of thePeace of the County
aforesaid who prosecuteth for our saidLord the King in this
behalf doth the like etc ThereforeLet a Jury thereupon
immediately come before the Justices of our said Lord the King above named
and others their Fellows aforesaid here by whom the Truth of the Matter will
be the better known and who have no Affinity to the said Edward Marriott< no role >
to recognize upon their Oath Whether the said Edward Marriott< no role > be guilty of
the Premises in the Indictment aforesaid above Specifyed or not because
as well the said James Waller< no role > who prosecuteth for our said Lord the King
in this behalf as the said Edward Marriott< no role > have put themselves upon that
Jury And the Jurors of the said Jury by Williams Beckford Esquire and Ive
Whitbread Esquire Sheriff of the said County for this purpose impannelled
and returned to Wit William George< no role > , George Sidall Samuel Robinson< no role > Thomas
Slater
< no role > Nathaniel Tooke< no role > Henry Pyke< no role > Edward Daintree< no role > Jonathan Shaebury
Thomas Reynolds< no role > , Thomas Holdsworth< no role > Thomas Nightingale< no role > and William
Standrup
< no role > being called come who being Chosen tryed and Sworn to Speake the
Truth of and upon the Premises aforesaid in the Indictment aforesaid above
Specifyed do say upon their Oath that the said Edward Marriott< no role > is guilty of
the premises aforesaid in the Indictment aforesaid above Specifyed in manner
and form as by the said Indictment is above supposed against him And that
he at the time of Committing the Felony aforesaid or at anytime since had no
Goods or Chattels Lands or Tenements to the Knowledge of the said Jurors
And hereupon the said Edward Marriott< no role > is asked by the Court here Whether
he can say any thing for himself why the Court here should not proceed
to Judgment and Execution thereof upon the Verdict aforesaid which said
Edward Marriott< no role > Prayeth that the Benefit of the Statute in such Case made
and Provided may be allowed to him in this behalf and it is allowed to him
Whereupon all and singular the premises being seen and fully understood
by the court here It is Considered by the Court here that the said Edward
Marriott
< no role > be transported as soon as conveniently may be to some of
his said Majestys Colonies and plantations in America in Parts beyond
the Seas for the Term of Seven Years according to the Form of the Statute
in such Case made an provided
