who being on Oath saith that on
Thursday last Deponent was driving a Waggon
belonging to Messrs. Langdale drawn by three Horsesabout
three quarters of a Maile beyond Kensington
Turnpikealong the Kensington
Road with
a load of Goods which has was taking to Mitcham when
the Deceased overtook him on Horseback who desired
Deponent to let him Drive the Waggon and requested
Deponent to ride the HorseDeponent then took the
Horse and the deceased Drove the Team about 20 Yards
when he Jumped up on the Shaft of on the near
side of the Waggon that Deponent rode behind the
Waggon and heard a voice exclaim Oh Lord Jack
that Deponent then looked towards the Waggon and
observed the deceased lying on his left side between the near
fore wheel and the near hind Wheel of the Waggon
and saw the near hind Wheel of the Waggon pass
over the loins of the deceased that Deceased immediately
after the Wheel had passed over him jumped up and
said I am not killed yet. that Deponent laid hold of
him by the Arm and with other assistance got him to
a Public House where Deponent left in the care of
the Master of the House and proceeded on with his
Waggon to Mitcham.
