John Smith proceedingsdefend This name instance is in set 31304714. , of the Parish of Stepney , was indicted for breaking the House of Tho. Warren proceedingsvictim , on the 5th Instant in the Day-time, and stealing thence a pair of Shag Breeches, with Silver Buttons, value 15 s. and other Cloaths . It appear'd that the Prosecutor keeps a Publick House , and the Prisoner and others being drinking there, he lost the Goods, and afterwards found the Breeches in Rag-Fair, where they were sold by the Prisoner's Order, as was plainly prov'd. There was no proof of the Burglary, so he was found Guilty of Felony .
