Resolved and Ordered by this Board
that the said Case be laid before Counsell for
his Opinion.

The Question put whether the
Action brought against Mr. Bennett one
of the late Overseers by one Mr. Fulham on
account of a Distress made on the Goods of the
said Fulham for the first and Second Quarters
for the Necessary releife of the Poor of this Parish
should be Defended by the Overseers of the Poor
for the time being Provided Counsell should
be of Opinion that the Church Wardens and
Overseers had Power to make such Distress

Carryed in the Affirmative

Resolved and Ordered by this Board
that the Overseers of the Poor for the time being
shall out of their Rate defray the Expences
Mr. Bennett the late Overseer shall be put
to on account of the said Action being brought
against him as aforesaid Provided he Immediately
Pay to the Present Overseers the Money he has in
his Hands belonging to this Parish being the
Ballance of his Account and shall likewise
out of their said Rate bear the Expences they
or any other Person or Persons shall be put
unto in Case any other Action or Actions shall
be brought against them or any Person or Persons
on the Account aforesaid.
