the above named defendant maketh
Oath that he this deponent Caused Bail to be put into and
pleaded to and Traverse this Indictment at the last Session, and
this defenent saith that he full Intended to have taken his
Tryal on such Indictment at this present Session but this deponent
Saith he never was under Bail upon any Indictment before the
present and that he this deponent was Ignorant of the necessity
of Giving Notice to the prosecutrix for the purpose of proceeding to
the Tryal thereof until Monday last when this deponent
happened Accidentally to meet his Solicitor
who Informed [..]
thereof and that it was then too late to give such Notice according
to the practice of this honourable Court and this deponent Saith
that he doth not make this Application for the mere purpose of
Relay for this deponent fully Intended to have taken his
Tryal at this present Session as aforesaid but from such his
Ignorance as before Stated and lastly this deponent Saith that
he fully Intended to [..] give-the necessary notice for such
Tryal and take his Tryal on the said Indictment at the next
Session
