Tennant, of New Built houses on the Ground of those burnt, or
taken decon are likewise liable to Distress and to be repaid by the
Land Lord.

In many Cases House and Buildings Hand Empty for many
Yeares in a Ruinous Condition through Disputes at Law or
where Infants are concerned till they fell down and the Ground
lies west, As also where Leases for Termes of Yeares are near
expireing and the houses so much out of repair as not, to be
habitable or worth the While of the Persons interested to repair
(as the Case is in severall Streets in Saint Ann's) during which
time the Surveyors who puts such Pavements into repair or
new Pave must be unavoidably kept out of their Money for
many Yeares if not in danger of Looseing it Or the Pavement
must lie unrepaired Which this Committee find the Justices
have thought so great an hardshipp Upon the Inhabitants
chosen to serve the Office of Surveyors and which they must
accept of under a Penalty That they have no, thought fitt to
Order the Surveyors to new pave in such like Cases and the
rather because some are not of Ability (the well qualified to
serve the Office) to Advance the Money All which this Committee
submitt to the Judgement and Opinion of this Court, Given
under Our hands this Ninthday of January 1730
